Terms of Service



1. Acceptance of Terms:

By accessing and using MotoStream, you agree to abide by these Terms of Service, our Privacy Policy, and all applicable laws and regulations. If you do not agree with these terms, please do not use our services.

2. User Accounts:

To access certain features of MotoStream, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information so that it is accurate, current, and complete. You are solely responsible for maintaining the security of your account credentials and for any activities or actions under your account.

3. Eligibility:

You must be at least 18 years old to use MotoStream. By registering, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into a binding contract.

4. User Responsibilities:

You are responsible for maintaining the confidentiality of your account information, including your password. You agree to accept responsibility for all activities that occur under your account. You also agree to comply with all applicable laws and regulations when using our platform.

5. Rental Agreements:

5.1 Role of MotoStream: MotoStream acts as a platform that facilitates the connection between vehicle owners and renters. While we do not own, operate, or control the vehicles listed on our platform, we do provide a service to verify the identity of users to enhance trust and safety within the community. However, MotoStream is not a party to the rental agreements made between vehicle owners and renters and disclaims any liability related to these agreements, except where explicitly stated.

5.2 Rental Agreement Terms: All car rentals through MotoStream are subject to separate rental agreements between the car owner and the renter. These agreements are entered into directly between the vehicle owner and the renter. MotoStream is not responsible for enforcing or mediating the terms of these agreements, except where it pertains to the verification of user identities or the condition verification process. Both parties are responsible for ensuring that their respective rights and obligations are clearly defined in the rental agreement.

5.3 Responsibilities of Vehicle Owners: Vehicle owners are responsible for ensuring that their vehicles meet all legal requirements, including insurance and safety standards, and that the information provided in the listing is accurate and up-to-date. Owners must also handle any disputes or claims that arise from the rental directly with the renter, except where MotoStream’s condition verification system is involved.

5.4 Responsibilities of Renters: Renters agree to return the vehicle in the same condition as when it was rented, except for normal wear and tear. Renters are responsible for any damage or violations incurred during the rental period. Renters must also comply with all applicable laws and regulations while using the vehicle.

5.5 Vehicle Condition Verification: MotoStream offers a system for verifying the condition of vehicles both at the time of pickup and return. This system may include digital inspections, photos, and reports. Both vehicle owners and renters agree to use this system as part of their rental agreement and acknowledge that the results of the verification process may be used to resolve disputes about vehicle condition.

5.6 Insurance: Vehicle owners and renters are required to maintain their own insurance coverage as required by law. MotoStream may provide optional insurance products through third-party providers, but these are separate from the platform's core services. Users should review the terms of any insurance policies they purchase to understand their coverage and limitations.

5.7 Limitation of Liability: To the maximum extent permitted by law, MotoStream is not liable for any direct, indirect, incidental, special, or consequential damages arising out of or in connection with your use of our services, including but not limited to:

  • Any aspect of the rental process, including the condition, legality, or safety of the vehicles rented through the platform, except where MotoStream’s verification systems apply.
  • The accuracy or reliability of any information provided by users (vehicle owners or renters) on the platform.
  • Any interactions, agreements, or disputes between users, including those related to payments, damages, or other liabilities, except where MotoStream’s verification systems apply.
  • Any loss or damage to personal belongings, physical injury, or financial loss incurred during or after the rental process.

MotoStream's total liability, whether in contract, warranty, tort (including negligence), or otherwise, is strictly limited to the amount you paid to MotoStream, if any, in the twelve months prior to the event giving rise to the liability.

6. Payments and Fees:

All payments for rentals are processed through MotoStream’s secure payment system. You agree to pay all applicable fees and charges associated with your use of the services. In the event of a dispute regarding payments or fees, MotoStream will facilitate communication between the involved parties but is not responsible for resolving the dispute. Refunds, if applicable, are subject to the terms outlined in the specific rental agreement between users.

7. Prohibited Activities:

You agree not to use MotoStream for any unlawful or prohibited activities, including but not limited to fraud, harassment, or infringement of intellectual property rights. This includes, but is not limited to, posting false, misleading, or defamatory content; impersonating another person or entity; and engaging in any behavior that disrupts or interferes with the proper functioning of MotoStream.

8. Termination:

MotoStream reserves the right to suspend or terminate your account and access to our services at any time, without notice, for conduct that we believe violates these Terms of Service or is harmful to other users or our platform.

9. Changes to Terms:

MotoStream reserves the right to modify these Terms of Service at any time. Significant changes to these Terms of Service will be communicated to you via email or a prominent notice on our platform before they take effect. Your continued use of MotoStream after such changes constitutes your acceptance of the new Terms of Service.



Privacy Policy

MotoStream is committed to protecting your privacy and complying with global data protection regulations, including the EU General Data Protection Regulation (GDPR) and Moroccan Law No. 09-08. This Privacy Policy outlines our practices regarding the collection, use, and disclosure of your information.

1. Information Collection:

We collect information you provide directly to us, such as when you create an account, list a vehicle, make a booking, or let us know. This information may include your name, email address, phone number, payment information, government-issued identification (such as driver’s license), vehicle registration forms, and other details necessary for our services. Sensitive information, including government-issued identification and vehicle registration forms, will be collected and stored securely in compliance with applicable data protection laws.

2. Information Use:

We use the information we collect to:

  • Provide, maintain, and improve our services.
  • Facilitate transactions and payments.
  • Communicate with you, including sending updates and promotional materials.
  • Monitor and analyze usage and trends to improve user experience.
  • Protect against fraudulent or unauthorized transactions.
  • Comply with legal obligations.

Our legal basis for processing your personal data includes your consent, our contractual obligations to you, compliance with legal obligations, and our legitimate interests in providing and improving our services.

3. Information Sharing:

We may share your information with:

  • Other users (e.g., sharing car owner information with renters and vice versa).
  • Third-party service providers who assist us in providing our services.
  • Law enforcement or government agencies when required by law.
  • In connection with a business transaction, such as a merger or acquisition.

We may transfer your personal data to third-party service providers outside your home country. Where data is transferred outside of the European Economic Area (EEA), Morocco, or your country of residence, we will ensure that appropriate safeguards are in place to protect your data, such as standard contractual clauses or other lawful transfer mechanisms recognized under GDPR and other relevant data protection laws.

4. Data Security:

MotoStream takes reasonable measures to protect your information from unauthorized access, use, or disclosure. We adhere to industry-standard security measures, including those outlined in ISO/IEC 27001, to protect your data from unauthorized access, disclosure, alteration, or destruction. However, internet or email transmission is only partially secure and error-free.

5. Cookies:

We use cookies and similar technologies to enhance your experience on our platform. You can control the use of cookies through your browser settings, but disabling cookies may affect the functionality of our services.

6. Your Rights:

Under GDPR and Moroccan Law No. 09-08, you have the right to:

  • Access your personal data and request a copy.
  • Rectify any inaccurate or incomplete personal data.
  • Request the deletion of your personal data under certain conditions.
  • Object to or restrict the processing of your personal data.
  • Withdraw your consent at any time without affecting the lawfulness of processing based on consent before its withdrawal.
  • Data portability, allowing you to request a copy of your data in a structured, commonly used, and machine-readable format.

7. Children’s Privacy:

MotoStream does not knowingly collect personal information from children under the age of 13. If we become aware that we have collected personal information from a child under 13, we will take steps to delete such information.

8. Changes to Privacy Policy:

MotoStream may update this Privacy Policy from time to time. Significant changes to our Privacy Policy will be communicated to you via email or a prominent notice on our platform before they take effect. Your continued use of MotoStream after such changes constitutes your acceptance of the new Privacy Policy.
